How do I get a property rezoned?

Rezoning applications are available at the Planning and Development office.

Procedures:

1. Application
   A petition to rezone property must be signed by the property owner(s). If the proposed area to be rezoned includes a number of properties, then the petition must be signed by at least 50% of the property owners within the area to be rezoned. The Planning and Zoning Commission may also, at its discretion, initiate a rezoning.
2. Planning and Development
   Following submittal of a completed petition to rezone property, Planning and Development Staff reviews the request for compliance with the criteria of the Scott County Land Use Policies and prepares a staff report for the Planning and Zoning Commission. The County Health and Secondary Roads Departments are notified of the request, as well as the Bi-State Planning Commission, the Soil Conservation Service and the planning staff of any City located within two miles of the area to be rezoned. 3. Public Hearing before the Planning and Zoning Commission
   All neighboring property owners within 500 feet of the property included in a rezoning request are notified of the location, time and date of the public hearing before the Planning and Zoning Commission by Planning and Development staff. A sign giving notice of the public hearing is posted on the property. Any person may submit comments or testify at the public hearing. 4. Public Hearing before the Board of Supervisors
   Following a recommendation by the Planning and Zoning Commission an applicant has seven days to pay the filing fee to request a public hearing before the Board of Supervisors. If a public hearing before the Board of Supervisors is requested, legal notice of the public hearing is published in the three county newspapers and the neighboring property owners are re-notified of the location, time and date of the public hearing before the Board of Supervisors. Any person may submit comments or testify at the public hearing.

Following the public hearing, the Board of Supervisors may approve the first reading of the ordinance for the rezoning, defer any action until a later meeting, or deny the request. If the Board approves the first reading of the rezoning request, then a second reading and publication in conformance with State law is required before the rezoning becomes effective.

Fees:

Charged in two stages. The maximum fee for each stage is $200. These fees are non-refundable.

  • $2 for each whole acre over five acres
